At Creative Media Development Inc. dba Hijinx Creative Agency (“Hijinx,” “we,” “us,” etc.), we forge brands that live at the intersection of innovation, culture, and community. We provide our services to business clients who want to understand and empower their customers’ preferences, habits, and interests to support their success. This requires that we collect and analyze data that may include personal information. Of course, we are also a business, so Hijinx also collects and uses personal information to operate the business. This Notice describes how Hijinx collects, protects, shares, and uses personal information when it is received by Hijinx for its own business use. This statement does not apply to household consumers, or the personal information we collect for our clients from their own customers, which is addressed by our clients’ privacy policies and practices.

Please be assured that Hijinx recognizes your personal information is valuable and we want you to be confident that we are handling it properly. We also want to provide you with information on how you can manage that information and the rights associated with your information.

When you interact with Hijinx online or face-to-face, you share your personal information in various ways. Sometimes we collect it directly from you and other times, we use technology to automatically collect personal information, as further described below.

This Notice applies to data we collect through our website, and any other sites or products that display these terms, as well as data we collect from third parties or from you in person. It does not apply to any website, service, or product that does not display or link to this Privacy Notice or that contains its own privacy notice. If you do not agree with our policies and practices, please do not use our services. By accessing our website, providing us with your personal information, or using our services, you agree to the terms of this Notice.

How we collect personal information

We may collect personal information from you directly or indirectly. When you fill out a form on our website or provide your contact information to us at an event, for example, you provide personal information directly to us. Other times, personal information is collected automatically as you use our website. And in some instances, third parties with whom we work provide personal information to us in connection with our business.

We collect personal information when you provide it

Whether you’re an employee, a client, or other individual interacting with our business, you may provide certain kinds of personal information directly by interacting with Hijinx online (via our website, including web forms, social media, etc.) and offline (by phone, email, in person – or even through postal mail).

We collect personal information from third-party sources

We may also collect personal information from third parties for Hijinx’s own marketing campaigns. This may include notifications we receive from third parties related to opportunities for Hijinx to participate in requests for proposals or other similar business invitations. We may also receive your information from your participation at events we sponsor or host when you register to attend an event.

We also may collect personal information from online social networks if you use them to connect with Hijinx, or if you take part in a forum, for example, on Facebook. We may collect personal information when you click “Share This” or “Like” buttons or otherwise use social media buttons or plug-ins.

We collect personal information using automated technologies

Sometimes personal information is collected by automated technologies and shared with us when website visitors navigate through our website.

We use cookies to store content and preferences which enables us to collect standard information your browser sends to websites you visit such as your IP address, device identifier (phone, tablet, etc.), browser type and language, and the site you came from as well as pages you visit and links you click on within our website. Having this information helps us improve our website and provide relevant content to website visitors.

You may decline to share certain personal information by blocking cookies on your internet browser. Keep in mind that declining certain cookies may in some cases decrease the functionality of the website or disable some features.

Other automated collection technologies – such as cookies, beacons, tags, and scripts – are used by us to analyze trends and administer the website. Targeted advertising

Although some of our business clients may serve targeted ads through the internet as part of their marketing efforts, Hijinx does not.

We do not knowingly collect information from individuals under 16 years old

All products and services we offer are for individuals 16 or older. We may, as part of the services we provide to our clients, receive personal information of individuals under age 16, but our clients are responsible for ensuring that the collection and sharing of this information is in compliance with applicable law. If we become aware that personal information of anyone younger than 16 has been provided to us, whether for an unlawful purpose or unlawfully, we will delete the information.

Do Not-Track requests

Some browsers offer a “Do Not Track” privacy preference. Generally, when a user turns on the Do Not Track Signal, their browser sends a message to websites requesting that the user not be tracked. Our website currently does not respond to “Do Not Track” signals.

How we use personal information

We know your personal information is important to you, so we want to be transparent and clear when explaining how we use that information.

We do not sell personal information

The personal information Hijinx collects will not be sold, rented, or traded to third parties for their own direct marketing purposes. We intend to honor the trust you have placed in us when you share your personal information with us.

Use of website information

We do track and capture analytic information associated with use of our website. Doing so allows us to make our website better and your experience easier. We also use personal information:

  • To send marketing communications, typically through email.
  • To communicate with our business clients about their orders.
  • To provide access to and maintain the security and integrity of the website.
  • To provide updates regarding the website and marketing information, such as special promotions or surveys, etc. available to our business clients.
  • To comply with legal and regulatory requirements applicable to our business and internal policies for maintaining records.
  • To protect all parties in the event of disputes.
  • To comply with court orders and legal processes, and to enforce our contractual obligations and this Privacy Notice.
  • For any other legal, business, or marketing purposes that comply with the practices described in this Notice.

When we share personal information

Once your personal information is collected, as detailed above, we may share it with third parties for various reasons. Note that when we share your personal information with a third party, we require that third party to protect the information consistent with privacy laws and requirements and limit its use of the information to performing the services they provide to us.

Payment processing

We use a third-party payment processor to process client payments. Hijinx does not process payment information directly. The personal information those payment processors receive includes name, email address, mailing address, billing address, phone number, and payment card or purchase order information. Submission of your payment information to us to pay an invoice is deemed your consent to share this information.

Analytics

We use Google Analytics and Hubspot to study how users interact with our website and keep it up and running.

Other business support vendors.

We also use other types of vendors to support our business, for example business service technology providers, benefits administration providers, and insurance providers.

If you make a public post, other users may see it

If you make a post or comment on a third-party social media site, such as on Facebook or Instagram, and you identify us, for example by tagging us using a hashtag (#) or “at symbol” (@), your personal information may be publicly available and is subject to the privacy policies of those third-party social media sites. As a reminder, this Notice describes how Hijinx will treat your personal information once it is in our possession.

We recommend you review the privacy policies of any third-party sites you visit to understand the data collection and use practices of that third party.

We may share feedback you provide to us

We want to hear how we’re doing. If you have suggestions for improving our services, we want those as well. Please be aware that any feedback relating to our services, including successful media campaigns with current clients, may be publicly shared by us.

Eventual successors may access information

In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, any personal information collected or controlled by us may be among the assets transferred to third parties as successors in interest. As part of this type of transaction, we reserve the right to transfer or assign your personal information to third parties. Other than to the extent ordered by a bankruptcy or other court, or as otherwise agreed to by you, the use and disclosure of all transferred user information will be subject to this Notice.

We ensure that any employee, contractor, corporation, organization, or vendor who has access to personal information in our systems is subject to legal and professional obligations to safeguard that personal information.

While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the Internet or form of electronic storage is 100 percent secure. Therefore, we cannot guarantee its absolute security.

We understand that you want to protect and control your personal information. This section details how you may review, update, correct, or delete your information.

Viewing or updating your personal information

You may update your name, email address, and phone number, as well as your email preferences by emailing us at privacy@hijinxagency.com with “Update my information” in the subject line with the updated information in the body of the email.

Opting out of promotional emails

If you do not wish to receive promotional emails from us, you may follow the unsubscribe process at the bottom of the promotional email you received or by emailing us at privacy@hijinxagency.com. Please keep in mind that you still may receive transactional emails from us (such as emails related to the completion of your registration or purchase, correction of user data, password reset requests, reminder emails you have requested, and other similar communications) that may be necessary for us to make the services available to you or respond to your questions and support requests.

European Economic Area, Switzerland, or United Kingdom

Hijinx currently does not direct its services to business clients in the European Economic Area (EEA), including Switzerland and the United Kingdom (UK). Some of our business clients may offer their products or services within the EEA, Switzerland, or the United Kingdom but as noted previously, any data collected is subject to that business client’s privacy practices. We do not intend for our website to be accessed by individuals in those jurisdictions. In the event we direct our services to business clients in the EEA, Switzerland, or UK, we will update this Notice to ensure we reflect any additional rights granted under applicable laws. Those updates will be made available within this Privacy Notice in accordance with those regulations.

California Consumer Rights

While Hijinx recognizes that the California Consumer Privacy Act (CCPA) provides specific rights to consumers who live in the state of California, Hijinx is currently not subject to CCPA. In the event Hijinx determines that it is subject to CCPA, we will update this Notice as needed to reflect any additional rights granted under CCPA. Those updates will be made available within this Privacy Notice in accordance with the law and any regulations.

Updates

This Privacy Notice will be updated to reflect Hijinx’s personal information handling practices. We reserve the right to amend this Notice at any time, for any reason, without additional notice to you, other than through posting the updated Privacy Notice on our website.
